Acceptance of These Terms
These Terms of Use govern your access to and use of the HypePull platform at https://www.hypepull.com and the HypePull Twitch Extension (together, the "Service"). By accessing or using the Service - whether as a streamer or as a viewer - you agree to be bound by these Terms. If you do not agree, do not use the Service.
Card Artwork & Intellectual Property
All card illustrations, booster artwork, and other visual content displayed on the Service (collectively, the "Artwork") are protected by copyright and other intellectual property laws. The Artwork is owned by the streamers who created it, or by the artists and designers they have commissioned or licensed. HypePull does not claim ownership of streamer Artwork and makes it available to you strictly for the purpose described below.
As a viewer, you are granted a personal, limited, non-exclusive, non-transferable, and revocable license to view the Artwork solely within the Service while collecting and interacting with cards. This license does not transfer any ownership or other rights in the Artwork to you.
Strictly Prohibited
Except where expressly authorized in writing by the rights holder, you may not, by any means and in any form:
- save, download, extract, scrape, or otherwise store the Artwork or its source files;
- capture, screenshot, or record the Artwork for the purpose of redistribution;
- copy, reproduce, reprint, or create derivative works from the Artwork;
- distribute, publish, share, resell, or make the Artwork publicly available; or
- use the Artwork for any commercial, promotional, or print purpose.
These restrictions apply regardless of the technical method used to access the Artwork, including inspecting the page, the browser developer tools, or the network requests of the Service.
HypePull's Promotional Use of Cards
HypePull reserves the right to use cards and their Artwork created on the platform for its own communication and promotional purposes - including, without limitation, on social media, in videos, on the HypePull website, and in marketing materials. This right exists to showcase the creativity of the streamers who use the Service.
Whenever HypePull features a card in this way, we commit to crediting the streamer who created it. If you are a streamer and would like a video or other piece of content featuring your card removed, you can ask us to take it down by contacting us at contact@hypepull.com, and we will comply.
Enforcement & Legal Remedies
Unauthorized use of the Artwork is a violation of these Terms and may also infringe the intellectual property rights of the streamers or their licensors. HypePull reserves the right to suspend or permanently terminate your access to the Service, with or without notice, for any violation of this section.
In addition, the rights holders of the Artwork may pursue any and all legal remedies available to them, including injunctive relief and claims for damages, against any person who saves, reproduces, or distributes the Artwork without authorization. By using the Service, you acknowledge and accept that such legal action may be taken.
Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
